License

The following license agreement applies to you if you are using TMPLX (hereafter referred to as SOFTWARE).  This is a legal agreement between you (either an individual or an entity) and ROBERT LAFLAMME.  By installing and using this product you are agreeing to be bound by the terms of this agreement.  If you do not agree to the terms of this agreement, you are not authorized to use the SOFTWARE product.

Software License
1. GRANT OF LICENSE. (Applicable to Single User Product only)  ROBERT LAFLAMME, grants to you the right to use one copy of the registered software programs STMPLX and MTMPLX on a single computer.  You can use the OCX module CTLTMPLX on illimited number of computer.  However connection between OCX and STMPLX are limited to the number of authorized client to STMPLX server.  Those applications are in "use" on a computer when they are loaded into temporary memory (i.e. RAM) or installed into permanent memory (i.e. hard disk) of that computer.  Installation of those applications on a network server to enable multiple simultaneous "use" of those applications requires a separate license for each usage.

1. GRANT OF LICENSE. (Applicable to Site License Product Only)  ROBERT LAFLAMME grants to you the right to use a limited number of copies (as specified in the site license agreement purchased) of the registered software program SOFTWARE within the entity the SOFTWARE is licensed to.  The registered SOFTWARE may only be installed on computers owned by the persons/entities the SOFTWARE is licensed to.  The SOFTWARE is in "use" on a computer when it is loaded into temporary memory (i.e. RAM) or installed into permanent memory (i.e. hard disk) of that computer.  If the SOFTWARE is installed on a network server to enable multiple simultaneous "use" of the SOFTWARE, the registered SOFTWARE may only be installed on computers where the multiple simultaneous "uses" can be monitored.  In addition, the number of multiple simultaneous "uses" of the SOFTWARE is limited to the number of copies specified in the site license agreement purchased.

2. COPYRIGHT.  The SOFTWARE is owned by ROBERT LAFLAMME and is protected by Canada copyright laws and international treaty provisions.  Therefore,  you must treat the SOFTWARE like any other copyrighted material.  You may not copy any of the printed material delivered with the SOFTWARE.

3. OTHER RESTRICTIONS.  You may not rent or lease the SOFTWARE, but you may transfer the SOFTWARE on a permanent basis provided you retain no copies and the recipient agrees to the terms of this Agreement.  You may not reverse engineer, decompile, or disassemble the SOFTWARE.  If the SOFTWARE is an update or has been updated, any transfer must include the most recent update and all prior versions.

Warranty

LIMITED WARRANTY.  Except as provided above, ROBERT LAFLAMME warrants that the SOFTWARE will perform substantially in accordance with the accompanying written material for a period of thirty (30) days from the date of installation.  Any implied warranties on the SOFTWARE are limited to thirty (30) days.  In states/jurisdictions that do not allow limitations on duration of an implied warranty, the above limitation does not apply to you.

CUSTOMER REMEDIES.  ROBERT LAFLAMME's entire liability and your exclusive remedy shall be repair or replacement of the SOFTWARE that does not meet ROBERT LAFLAMME's limited warranty and which is returned to ROBERT LAFLAMME.  This Limited Warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication.  Any replacement SOFTWARE is warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

NO OTHER WARRANTIES.  To the maximum extent permitted by law, ROBERT LAFLAMME disclaims all other warranties, either expressed or implied, including, but not limited to implied warranties of merchantability and fitness for a particular purpose, with regard to the SOFTWARE and the accompanying written material.  This limited warranty gives you specific rights.  You may have others which vary from state/jurisdiction to state/jurisdiction.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent permitted by law, in no event shall ROBERT LAFLAMME be liable for damages whatsoever (including without limitation, damages for the loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this ROBERT LAFLAMME SOFTWARE, even if ROBERT LAFLAMME has been advised of the possibility of such damages.  Because some states/jurisdictions do not allow for the exclusion or limitation of liability for consequential damages, the above limitation may not apply to you.

Registering

TMPLX is being distributed initially as Shareware. It is not free or public domain. This means you may copy and distribute it freely but should you find it useful and use it beyond an initial evaluation period of thirty (30) days you are both legally and morally obliged to pay the license fee.

Registered users will be sent a registration number to legally enable TMPLX.  This number will be good for all subsequent versions of the program that may become available. ROBERT LAFLAMME will endeavor to inform you when such upgrades are released.

Please provide an eMail address so ROBERT LAFLAMME can inform you of your registration code as soon as your order is received, and give timely information on upgrades.  

Trial Use License

TMPLX is NOT a public domain program.  It is Copyright (c) 1999 by ROBERT LAFLAMME. This software and accompanying documentation is protected by Canada Copyright law and also by International Treaty provisions.  Any use of this software in violation of Copyright law or the terms of this limited license will be prosecuted to the best of our ability.  The conditions under which you may copy this software and documentation are clearly outlined below under "Limited Distribution License".

ROBERT LAFLAMME hereby grants you a limited license to use this software for evaluation purposes for a period not to exceed thirty (30) days.  If you intend to continue using this software (and/or it's documentation) after the thirty (30) day evaluation period, you MUST make a registration payment to ROBERT LAFLAMME at this address:

Using this software after the thirty (30) day evaluation period, without registering the software is a violation of the terms of this limited license.

Licensee shall not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program except as provided in this agreement.  Any such unauthorized use shall result in immediate and automatic termination of this license.

All rights not expressly granted here are reserved to ROBERT LAFLAMME.

Trial Use Warranty

The Shareware evaluation version is provided AS IS.  ROBERT LAFLAMME MAKES NO WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE.

Limited Distribution License

As the copyright holder for TMPLX, ROBERT LAFLAMME authorizes distribution only in accordance with the following conditions.

The TMPLX package is defined as containing all the material listed in the packing list (PACKING).  If any files listed in the packing list or the packing list file itself are missing, then the package is not complete and distribution is forbidden.  Please contact us to obtain a complete package suitable for distribution.

The TMPLX package - including all related program files and documentation files - cannot be modified in any way and must be distributed as a complete package, without exception.

No price or other compensation may be charged for the TMPLX package.  A distribution cost may be charged for the cost of the diskette, shipping and handling, as long as the total (per disk) does not exceed US $8.00 in the U.S. and Canada, or US $12.00 internationally.

The TMPLX package CANNOT be sold as part of some other inclusive package.  Nor can it be included in any commercial software packaging offer, without a written agreement from ROBERT LAFLAMME.

The Guide to Using TMPLX may not be reproduced in whole or in part, using any means, without the written permission of ROBERT LAFLAMME.  In other words, the disk-based documentation may not be distributed in printed (hard copy) form.

The TMPLX package cannot be "rented" or "leased" to others.

Licensee shall not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program except as provided in this agreement.  Any such unauthorized use shall result in immediate and automatic termination of this license.

All rights not expressly granted here are reserved to ROBERT LAFLAMME.
